The following terms and conditions (“Terms”) govern your use of the Outleap Website and you should read them carefully before using this website. In particular, for details on the cookies we use and how to change your browser settings, please see our Cookie Policy below.

WHO DO THESE TERMS APPLY TO?
These Terms apply to:
- “Visitor(s)” to the Outleap Website, i.e. someone who visits and/or uses the Outleap Website but who does not access the Outleap Platform;
- “Student(s)” using the Outleap Platform, i.e. someone who uses the Outleap Platform to help plan and/or write their personal statement;
- “Teacher(s)” using the Outleap Platform, i.e. someone who uses the Outleap Platform in a teaching or supervisory capacity, for example, to provide feedback, opinions or comments on Students (and review feedback, opinions or comments provided by Outleap), to review Students’ statement related progress, activities and/or comments;
- “Other School Staff”, i.e. someone who has been given administrative access rights to the Outleap Platform and is using the Outleap Platform to administer Students’ use of the Outleap Platform and carry out supervisory tasks.
Unless we say otherwise, these Terms apply to all Visitors, Students, Teachers, and Other School Staff.
WHAT DO THESE TERMS COVER?
These Terms include:
- Our Terms of Use, which govern the use of the Outleap Website;
- Our Acceptable Use Policy, which sets out the permitted uses and prohibited uses of the Outleap Website. When using the Outleap Website, you must comply with this Acceptable Use Policy.
- Our Cookie Policy, which sets out information about the cookies on the Outleap Website.
These Terms also refer to our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us.
We may amend these Terms from time to time. Please check these Terms regularly to ensure you understand the terms that apply at that time.
1. Website Terms of Use
ACCESSING THE OUTLEAP WEBSITE
You may access and use some areas of the Outleap Website as a Visitor. However, certain areas of the Outleap Website (the Outleap Platform) are only accessible to you if you are a Student, Teacher, or Other Staff Member.
By using the Outleap Website, you confirm that you accept these Terms of Use and that you agree to comply with them.
If you do not agree to these Terms of Use, you must not use the Outleap Website.
WE MAY MAKE CHANGES TO THE OUTLEAP WEBSITE
We may update and change the Outleap Website from time to time to reflect changes to, for example, our users’ needs or technical, operational or other business priorities.
WE MAY SUSPEND OR WITHDRAW THE OUTLEAP WEBSITE
We do not guarantee that the Outleap Website, or any content on it, will always be available or be uninterrupted. Our status (and that of any identified contributors) as the authors of content on the Outleap Website must always be acknowledged.

Where the Outleap Website contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources.
USER GENERATED CONTENT IS NOT APPROVED BY US
The Outleap Platform may include information and materials uploaded by Students, Teachers, or Other School Staff, including in personal statements, CVs, records of interactions, target actions, feedback, opinions and comments. This information and these materials have not been verified or approved by us. The views expressed by Students, Teachers, or Other School Staff on the Outleap Website do not represent our views or values.

UPLOADING CONTENT TO THE OUTLEAP PLATFORM
Whenever you make use of a feature that allows you to upload content to the Outleap Platform, or to otherwise make content available to other Students, Teachers, and/or Other School Staff, you must comply with the content standards in our Acceptable Use Policy.
We have the right to remove any content you post or upload to the Outleap Platform if, in our opinion, that content does not comply with the content standards set out in our Acceptable Use Policy.
When you submit comments, opinions, or other feedback to us about the Outleap Website, you agree that we can use and share (but do not have to) such feedback for any purpose without compensation to you.
WE ARE NOT RESPONSIBLE FOR VIRUSES AND YOU MUST NOT INTRODUCE THEM
We do not guarantee that the Outleap Platform will be secure or free from bugs or viruses. You should use your own virus protection software.
You must not misuse the Outleap Platform by knowingly introducing viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Outleap Platform, the server on which the Outleap Platform is stored, or any server, computer, or database connected to the Outleap Platform. You must not attack the Outleap Platform via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offense under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will cooperate with those authorities by disclosing your identity to them. WHICH COUNTRY’S LAWS APPLY TO ANY DISPUTES?
These Terms of Use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident in another jurisdiction, in which case you may also bring proceedings in your home jurisdiction.
SEVERABILITY
If any court or competent authority decides that any of the provisions of these Terms of Use are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

2. Acceptable Use Policy
This Acceptable Use Policy sets out the content standards that apply when you upload content to the Outleap Website, link to the Outleap Website, or interact with the Outleap Website in any other way.
PROHIBITED USES
You may only use the Outleap Website for lawful purposes. You may not use the Outleap Website:
(i) in any way that breaches any applicable law or regulation;
(ii) in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose;
(iii) for the purpose of harming or attempting to harm others in any way (including bullying, intimidating, abusing, threatening, harassing, defaming or violating any rights of another person, including Students and Teachers);

(iv) upload files to the Outleap Website that contain software or content protected by intellectual property laws (patents, trademarks, trade secrets, copyrights or other proprietary rights) or confidentiality, unless you own or control such rights or have received all necessary consents;
(vi) directly or indirectly transfer any data you receive from us to (or use such data in connection with) any social network or similar third party, even if a Student, Teacher or Other School Staff consents to such transfer; or
(vii) sell or distribute any information or content provided by or related to us or modify, adapt, translate or create derivative works based on statements or material on the Outleap Website.
CONTENT STANDARDS
These content standards apply to any and all content which you post or upload to the Outleap Website (contributions), including records of interactions with your Students or Teacher(s) and Teachers’ feedback, opinions and comments about Students, etc.
You must comply with the spirit and the letter of the following standards. The standards apply to each part of any contribution as well as to its whole.
Contributions must:
(i) be accurate (where they state facts);
(ii) be genuinely held (where they state opinions); and
(iii) comply with applicable law in the UK and in any country from which they are posted.
Contributions must not:
(i) contain any material which is defamatory of any person;
(ii) contain any material which is obscene, offensive, hateful or inflammatory;
(iii) promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, gender reassignment, pregnancy or maternity, marriage or civil partnership or age;
(iv) infringe any copyright, database right or trade mark of any other person;
(v) be likely to deceive any person;
(vi) be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
(vii) promote any illegal activity;
(viii) be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety or be otherwise objectionable;
(ix) be likely to harass, upset, embarrass, alarm or annoy any other person;
(x) be used to impersonate any person, or to misrepresent your identity or affiliation with any person; or
(xi) give the impression that they emanate from us, if this is not the case.
If you see something on the Outleap Website that you find objectionable or you believe breaches this Acceptable Use Policy, please promptly report it to us at [email protected]. Please keep in mind that this does not guarantee that we will remove the content from the Outleap Website.
BREACH OF THIS POLICY
We will determine, in our discretion, whether there has been a breach of the provisions of this Acceptable Use Policy. When a breach has occurred, we may take such action as we deem appropriate.
